Sangamon Co. Judge Tosses Decision Voiding Pritzker’s Executive Orders

In early July, a judge in downstate Clay County voided Gov. JB Pritzker’s executive orders in a sweeping order that he applied to the entire state, at the request of a southern Illinois lawmaker who sued Pritzker over his response to the pandemic.

More than six months later, Sangamon County Judge Raylene Grischow has essentially voided Judge Michael McHaney’s July 2 order in the case of Rep. Darren Bailey, R-Xenia.

A circuit court judge in Springfield is now weighing whether to dismiss lawsuits by Republican Rep. Darren Bailey and others challenging Gov. JB Pritzker’s use of emergency powers during the COVID-19 pandemic.

The Illinois Supreme Court has declined to consider a downstate legal battle over Gov. J.B. Pritzker’s COVID-19-related orders and moved the case to Sangamon County. It'll be consolidated with a similar case.

The move comes as the first-term Democrat was expected in a Clay County courtroom this week.

A Clay County judge ruled today Governor J-B Pritzker had no authority to issue multiple Executive Orders to keep the State of Illinois locked down during the COVID-19 pandemic.

The U.S. Attorney for the Southern District of Illinois is arguing a lawsuit between a state representative and Gov. J.B. Pritzker should remain in circuit court, after state Attorney General Kwame Raoul's office moved the case up to the federal level.

A lawmaker who portrays himself as an outsider found himself on the outside Tuesday. A group of protestors, meanwhile, made their voices heard as state lawmakers convened for the first day of a special legislative session.

Republican Representative Darren Bailey of southern Illinois filed the lawsuit last week challenging Pritzker’s decision to continue the “stay-at-home” order through May.

The republican lawmaker's lawsuit claimed Governor J-B Pritzker did not have the power to keep the state under a stay at home order and disaster proclamation. The suit argued Illinois’ Emergency Management Act only allows Pritzker to use emergency powers for a short time, then the state legislature must step in.

WSIU partnered with The Southern Illinoisan newspaper to interview candidates ahead of the March 17 primary in Illinois.

All candidates were asked the same questions, and given up to 30 minutes for their interview. In the 55th State Senate race, there are two men running for the Republican nomination, as State Senator Dale Righter is not seeking re-election. State Representative Darren Bailey and Jeff Fleming are vying for the open seat.
